But now, a wage-based selection process has received a green light from the White House and regulatory bodies in August 2025.

On August 8, 2025, the Office of Information and Regulatory Affairs (OIRA) approved a new H-1B rule.
On August 14, 2025, the White House gave final clearance to proceed.
The Department of Homeland Security (DHS) and U.S. Citizenship and Immigration Services (USCIS) are now preparing to publish the proposal in the Federal Register.
This publication will open a 30–60 day public comment period before the rule can be finalized.

What Will Change?
Instead of the current random lottery, H-1B visa selections will be weighted toward higher wage levels. That means:
Applicants offered higher salaries will have a greater chance of selection.
Employers who can pay more competitive wages will benefit.
Entry-level or early-career applicants may face reduced chances, unless they secure roles in companies that meet higher wage tiers.
When Will It Take Effect?
The new system will not roll out in August 2025 despite some headlines. Instead, if finalized, it is expected to begin with the FY2027 H-1B cap season. That means:
Registrations in March 2026 could already reflect wage-based selection.
